Terms and Conditions for Processing Personal Data

WAFE s.r.o., Company ID No.: 04694651, with its registered office at 931/40b, Prague 9, 190 00, entered in the Commercial Register maintained by the Municipal Court in Prague under reg. no. C 251696 (hereinafter referred to as “WAFE”), is the controller of the Users’ personal data processed within the framework of these Principles of the Protection of Personal Data and Privacy (hereinafter referred to as the “Principles”). WAFE processes the Users’ personal data in accordance with Act No. 101/2000 Coll., on the Protection of Personal Data, as later amended (hereinafter referred to as the “Personal Data Protection Act”). From 25 May 2018, the Users’ personal data will be processed in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation) (hereinafter referred to as the “Regulation”), and in accordance with the valid legal regulations, which replaces  the Personal Data Protection Act. WAFE s.r.o. shall take every step to remove all the personal data of a given user at that user’s request.

WAFE only processes personal data that the User provides to it in connection with a visit to the webpages, by filling in an inquiry form, questionnaires, by concluding a Contract (purchase or work) for WAFE products or for the use of the myWAFE tool on the page https://my.wafe.eu/cs/sign/in.  

This particularly applies to the following personal data, which the User imparts:

  • e-mail address;
  • telephone number;
  • name and surname;
  • bank account number;
  • address of planned or current building;
  • technical parameters of building (number of rooms, number of floors, design)

and other personal data that we obtain from the Users through their use of the WAFE product when they are connected to the Internet: 

  • IP address of User’s device;
  • Basic geographical location;
  • Operating parameters of unit (temperature, humidity, CO2 level).

The main reason why WAFE processes its Users’ personal data is so that they can communicate about the construction project of a potential customer and on the common interest of the realisation of WAFE technology in the customer’s construction project or so that it can ensure and constantly increase the quality, control and safety of its products.

Furthermore, Wafe processes the Users’ personal data for the purpose of:

  • improving the quality and the further development of WAFE products;
  • performing analyses and measurements with the goal of determining how the WAFE products are used;
  • sending commercial messages and  newsletters.

WAFE s.r.o. may perform analyses on the behaviour of the users on its webpages. These analyses include, for example: the measurement of the number of visitors, the number of users viewing a banner or section and the number of click-throughs on the individual banners or sections. The users should also be aware that the data that they voluntarily provide in the discussion forums or other automatically generated pages may be used by a third party. Such use of the personal data cannot be controlled, however, and WAFE s.r.o. cannot bear and bears no responsibility for this.

Users should be aware of the fact that some of the information on users can be automatically collected over the course of our server’s standard operations (e.g. the IP address of the user’s computer) and also through the use of cookies (small text files that are stored on the user’s computer and through which the server can recognise a user who has already visited the webpages and then can record his behaviour and accordingly adapt the design and the content). Cookies are not programs that could cause damage to the user’s computer. Most browsers offer the option of not accepting cookies.

WAFE protects and ensures the security of your personal data. It carefully chooses its partners to whom it entrusts the data and that are capable of ensuring such technical and organisational security of your personal data so that there is no unauthorised or accidental access to the personal data or its other abuse. Third parties that could have access to your personal data are the business partners of WAFE s.r.o. providing supplemental services to the products and services of WAFE s.r.o. (designer work, architectural work, assembly and service work and more), services related to marketing messages to customers and more. WAFE s.r.o. will provide the list of these parties to the customer upon request.

WAFE can process your personal data on the basis of your granted approval or also on the basis of its justified interest (in particular the processing of personal data for the purpose of direct business negotiations or marketing) of for the fulfilment of a concluded Contract in the scope of the personal data that is necessary for such fulfilment. WAFE may have access to commercial databases of third parties that control and process personal data, act in accordance with their business interests and are authorised to provide access to WAFE. If WAFE works with the databases of third parties by downloading or reproducing its content on its devices, it only does so until the end of the business case or the justified interest.

We would like for you to know that, in relation to your personal data that you agreed that we could process, you have the right to withdraw, at any time and free of charge, this agreement. 

This withdrawal does not affect the legality of the processing based on the agreement that was provided before it was withdrawn. Withdrawing the agreement also has not influence on the processing of personal data that the Controller processes on the basis of another legal foundation that the agreement (i.e. especially if the processing is necessary for fulfilling a contract, legal obligation or for other reasons specified in the valid legal regulations). If the approval was granted electronically, it can simply be withdrawn by clicking on the URL link in the email that was sent during the confirmation of the registration. It is necessary to keep this email. An electronically-granted agreement can also be withdrawn by sending an email message to the address info@wafe.cz. An agreement granted in writing can be withdrawn by filling in the appropriate form in the Controller’s registered office.

The processing of personal data that you have provided to us on the basis of your agreement will take place for a period of at most 5 years, provided this agreement with the processing of the personal data is not withdrawn earlier. We only process the personal data that we process on the basis of another legal basis for the absolutely necessary period of time.

In the event of a breach of your rights connected with the processing of your personal data, you can submit a complaint to the Office for Personal Data Protection.
